By accessing and using FrostyNow's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

2. Description of Service

FrostyNow provides a cloud-based platform for controlling smart window privacy film through WiFi-enabled ESP32 devices. Our service includes:

• Remote control of window privacy states
• Scheduling and automation features
• Multi-device management
• Mobile and web access

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating an account
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Transmit any malicious code or harmful content
• Reverse engineer or attempt to extract source code

5. Hardware Requirements

FrostyNow's service requires compatible ESP32 hardware and privacy film, which are sold separately. We are not responsible for:

• Hardware installation or malfunction
• Compatibility with third-party devices
• Physical damage to windows or property
• Electrical issues or power failures

6. Payments and Subscriptions

Subscription fees are billed in advance on a monthly basis. You agree to:

• Provide current, complete, and accurate billing information
• Pay all charges at the prices in effect when incurred
• Accept that fees are non-refundable except as required by law

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We reserve the right to:

• Modify or discontinue the service with reasonable notice
• Perform scheduled maintenance
• Suspend service for non-payment

8. Limitation of Liability

FrostyNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount you paid in the last 12 months.

9. Warranty Disclaimer

The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will immediately cease.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes. Your continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FrostyNow operates, without regard to its conflict of law provisions.
